1. Platform Fees

Borealis Terminal charges a flat 2.5% platform fee on all completed transactions for Standard (free) accounts. This fee is deducted from seller proceeds automatically during settlement in USDC on the Hedera network. Prices are displayed in CAD with USDC equivalent shown at the current exchange rate. Reduced-fee Pro, Elite, and Enterprise tiers are coming soon.

2. Liability & Disclaimers

Borealis Terminal is provided "as is" without warranty. We are not responsible for disputes between buyers and sellers, lost items, damaged goods during shipping, or any transaction-related losses. Users transact at their own risk. All transactions are final and irreversible once settled on the blockchain.

3. Escrow & Settlement Terms

Funds are held in escrow for up to 14 days after purchase, allowing for dispute resolution. After 14 days, escrow is automatically released to the seller. Refunds are only issued if both parties agree or if Borealis determines fraud has occurred. All settlements occur in USDC on the Hedera network and cannot be reversed.

4. User Verification & Trust System

Borealis Terminal operates a multi-layer trust verification system. Users earn trust points through: (a) Email verification (+10 pts), (b) Social media verification via public code posting on supported platforms (+15 pts each, max 3 accounts), (c) Government-issued ID verification with AI-assisted review (+30 pts), (d) Transaction history (organic, +2 pts per completed transaction, max 20 pts), and (e) Account age bonuses. Trust levels (Unverified, Basic, Verified, Trusted, Premium) determine marketplace visibility and feature access. Social media verification requires posting a unique BT-code publicly; once confirmed, the post may be removed. Government ID submissions are reviewed within 24-48 hours using AI analysis followed by human review. Documents are processed securely and not stored permanently. Verification status can be revoked for policy violations or fraudulent submissions.

5. AI Agent Disclaimers

AI agents operating on this platform, including Aurora (support), Migration Officer (store import), and marketing agents, are autonomous software systems powered by third-party AI models. Borealis Terminal does not guarantee the accuracy, reliability, or legal compliance of AI-generated content, marketing campaigns, or recommendations. Users assume full responsibility for AI agent outputs and their consequences. AI agents are not employees, contractors, or agents of Borealis Terminal.

6. Subscription Tiers

All users currently operate on the Standard (free) tier, which includes a 2.5% platform fee on completed transactions. Pro and Elite tiers with reduced fees, priority support, and advanced features are in development and coming soon. Tier benefits are subject to change with 30 days' notice.

7. Store Migration Service

The Store Migration Service allows users to import listings from external platforms (e.g., eBay, Etsy, Shopify). Migration requires ownership verification via a unique BT-code placed on the source store. Borealis Terminal does not guarantee successful import of all listings and is not responsible for data accuracy from external platforms. Migration requests are subject to admin review.

8. Prohibited Activities

Users may not: sell illegal or regulated items, engage in fraud or misrepresentation, use AI agents for spam or harassment, manipulate ratings/reviews, attempt to circumvent the trust verification system, submit fraudulent verification documents, create multiple accounts to evade sanctions, engage in off-platform transactions to avoid fees, or violate any applicable laws. Violations result in progressive enforcement: warnings, muting, temporary suspension, or permanent ban depending on severity.

9. Blockchain & USDC

All payments occur in USDC stablecoin on the Hedera network. Transaction records are anchored on Hedera Consensus Service (HCS) for immutable audit trails. Users are responsible for maintaining secure Hedera wallet access. Borealis Terminal is not liable for lost private keys, stolen wallets, or wallet security failures.

10. Content Moderation

All listings are subject to automated content moderation including prohibited keyword detection, AI-powered content analysis, and human review. Messages between users are monitored for policy violations including profanity, off-platform solicitation, harassment, and scam attempts. Messages are retained for 30 days and then automatically deleted.

11. User Data & Privacy

We collect personal data (name, email, verification documents) to operate the platform, verify user identity, and comply with applicable regulations. Your data is never sold to third parties. Verification documents are processed securely and not stored permanently after review. Blockchain transactions are immutable and transparent per Hedera protocol. Email communications are processed by our AI support agent (Aurora) for faster response times.

12. Modification of Terms

Borealis Terminal reserves the right to modify these terms with 30 days' notice via email and platform notification. Continued use of the platform constitutes acceptance of updated terms.
